"Forest Experience"
General Provisions and Scope
The following general terms and conditions apply to all services and products provided by Forest Experience, Nadine Krysostan, Rue Auguste Beernaert 11, 1170 Brussels to offline and online customers, hereinafter referred to as "Customer".
Forest Experience offers forest bathing courses in nature. A detailed description of the services offered can be found on the Forest Experience website (www.forestexperience.be).
My courses are preventative measures and serve as general health care. They do not make any healing promises and are not a substitute for treatment by a doctor, therapist or alternative practitioner.
I undertake to maintain absolute confidentiality regarding all professional, business and private matters of the participants that may become known during the course.
Each participant assumes full responsibility for his or her actions within and outside of the entire activity.
Registration and (online) communication
A contract between Forest Experience and the Customer is concluded exclusively through the registration by email or via the contact form on the Forest Experience website, a written confirmation from Forest Experience and the payment of the corresponding course fee.
Special requests and registrations are only valid if they have been confirmed by Forest Experience in writing. The registration confirmation is sent along with the invoice.
Even though the services published online on the Forest Experience website are compiled with great care, it is still possible that the information offered is incomplete, contains material errors or is not up to date. Obvious mistakes or errors in the display of services are not binding on Forest Experience. Forest Experience is only bound by an obligation of means with regard to the correctness and completeness of the information provided. Forest Experience is in no way liable in the event of manifest material errors, typesetting or printing errors.
If the Customer has a specific question about the services offered, please contact Forest Experience before registering, via info@forestexperience.be.
Payment
The payment of the course fee will be made by bank transfer to account number BE55 3632 4477 0244, respecting the payment date mentioned on the invoice Forest Experience will issue. All prices mentioned on the invoice are expressed in EURO, excluding VAT, as Forest Experience is exempt from VAT in accordance with article 44 of the VAT code.
Only payments received before the start of the course entitle the customer to participate. If the course fee has not been received in the account of Nadine Krysostan, "Forest Experience" at the payment date mentioned on the invoice, Forest Experience reserves the right to exclude the Customer from participation through written notification without giving any further reasons.
Number of participants
In order to run the courses efficiently and to maintain a high quality standard, the number of participants per course is limited. The corresponding number of participants can be found in the individual course descriptions. Forest Experience considers registrations in the order in which they are received and therefore recommends an early registration. The courses are aimed at participants aged 18 and over.
The offer of services is valid as long as the maximum number of participants has not been reached and can be adapted or withdrawn at any time by Forest Experience. If the number of participants is exceeded, there is no guarantee that additional customers will be accepted. However, Forest Experience will be happy to put customers on a waiting list.
Cancellations and refunds
If a customer is unable to attend a booked course, no costs will be incurred, if a written cancellation is received by the Customer at least 7 days before the start of the course. If the written cancellation is received no later than 4 days before the start of the course, 50% of the course fee will be due. No refunds wiIl be given if the Customer cancels his/her participation later than 4 days prior to the start of the course.
However, it is possible for the Customer to reschedule his/her participation to another course taking place at an alternative time and place. Such rescheduling is subject to availability and in agreement with Forest Experience.
It is possible for someone else to participate and take the place of the Customer. In case of such a replacement, the Customer should contact Forest Experience with the contact details of the person replacing the Customer, at least 48 hours prior to the course. Forest Experience reserves the right not to accept the participation of the person that is proposed.
Cancellation of a course by Forest Experience
Forest Experience reserves the right to cancel a course before it begins, even at short notice, for important reasons. Important reasons may include: illness of the course guide, insufficient number of participants or force majeure. In particular in the case of adverse weather conditions, such as storms or bad weather, danger of snow or broken branches, closure of the forest area due to tree felling, etc., Forest Experience reserves the right to cancel or postpone a course at short notice for your own safety.
In this case, Forest Experience is only obliged to refund course fees that have already been paid. Any further claims or reimbursement payments for, for example, transport costs are excluded.
Conditions for participation and limitations of liability
The flora and fauna of the forest is to be respected and protected. Participants agree to follow the rules specified by the course guide at the beginning of each course, as well as the instructions given by the course guide during the course. In case of non-compliance, Forest Experience reserves the right to exclude a participant from the course. No refund of costs is possible.
Participants undertake to maintain confidentiality towards third parties regarding any confidential circumstances of other participants that become known during a course.
All forest bathing courses are designed in a way that they can be undertaken by people in good health without causing accidents or injuries.
During the forest bathing courses, participants are asked to move considerately and with care, respecting the natural forest area and paying attention to possible dangers (e.g. loose branches that could fall from trees, moving safely on uneven terrain).
Good health is a prerequisite for participation in my forest bathing courses. Each participant undertakes to inform Forest Experience of any health problems they may have (colds, allergies, illnesses, intolerances, etc.). Participation in the courses under the influence of drugs or alcohol is not permitted.
By registering for a course, the Customer confirms that he/she is fully responsible for his/her physical and mental health, that he/she acts on his/her own responsibility and that he/she releases Forest Experience from all liability claims. By agreeing with these terms and conditions, the Customer acknowledges that the courses organised by Forest Experience are not intended as a substitute for any medical or psychological treatment by a medical doctor or psychotherapist. If the Customer is currently suffering, or has suffered in the past from any psychological condition (e.g. depression, psychosis,...) it is the Customer's responsibility to decide, together with a medical doctor or a qualified psychotherapist, whether he/she is apt to participate in the course.
Forest Experience is not liable for items taken to the forest bathing courses or for other direct damages and costs, including loss of earnings, lost profits or claims from third parties, loss of data, travel costs, as well as consequential and financial losses of any kind.
Applicable law - Disputes
The contract and any dispute arising between parties shall be governed solely by Belgian domestic law. All disputes between the parties shall be settled before the Belgian courts, judicial district of Brussels.
Partial invalidity
Should parts of these provisions be or become invalid or ineffective in whole or in part, the remaining provisions shall nevertheless continue to apply.
